DMCA & Copyright Policy

TMPST LLC, doing business as “On The Hitlist” ("TMPST LLC," "On The Hitlist," "we," "our," or "us"), respects the intellectual property rights of others and expects our users to do the same. This Policy describes how we respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”).

Because uploading music you do not own is a serious problem, we act on valid notices and terminate repeat infringers. Only submit content you own or are authorized to use.

1. Reporting Alleged Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe material on the Service infringes your copyright, you may send a written notice (a “DMCA Notice”) to our Designated Copyright Agent listed in Section 4.

To be valid, your DMCA Notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it (such as a URL or profile);
  4. Your contact information — name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

2. Our Response

Upon receiving a valid DMCA Notice, we will expeditiously remove or disable access to the allegedly infringing material and will make a reasonable effort to notify the user who posted it. We may also document the notice for our repeat-infringer records.

3. Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Copyright Agent. To be valid, it must include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, mailing address, and telephone number; and
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., that you consent to the jurisdiction of any judicial district in which we may be found), and that you will accept service of process from the person who filed the original DMCA Notice or their agent.

If we receive a valid counter-notification, we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat Infringer Policy

We will, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who are repeat infringers of copyright. We may also remove content and take other action at any time, with or without notice, for conduct we believe infringes the rights of others or violates our Terms.

6. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages. Do not make false claims. If you are unsure whether material is infringing, consider seeking legal advice before submitting a notice.
